Magistrates set bail bonds in Collin County Jail and city jails most mornings, so, if someone is processed into the jail after the Magistrate leaves, they are held in jail without a bond until either:
Sometimes they are transferred into from the city jail to county jail and arrive at county too late to see a county judge, so they wait until the next hearing is set, usually the next morning or 2 days later, because sometimes the Magistrates only come in every other day.- Bail Bond companies MUST wait until a Judge holds a Collin County bail bond hearing to set a bond amount.
- This means that with the right bail bond paperwork and paying the bond, a person does not have to wait until the next bail bond hearing date to be released. Attorney Writ Bond vs. Using a Bail Bondsman: To avoid waiting until a Judge holds a bond hearing, an attorney can get an Attorney Writ bond set or secure a bail bond for the amount set by the Judge as a result of a hearing or Attorney Writ process.
- Bail bondsmen have to wait hours, sometimes days, for the Judge to hold a bail bond hearing. An attorney writ bond does not require waiting for the judge to hold a hearing.
- An attorney writ bond can get you out on the weekend or any time before a bond amount is set.
- An arrested person has to sit in jail until the bond hearing is held, but, by filing an attorney writ bond, the arrested person does not have to wait for a Judge to set the bond amount.
- Attorney files a writ bond or “writ of habeas corpus”.
- Collin County has a schedule of bonds which are set upon the filing of a writ by an attorney on behalf of the client.
Writ Bond Process:
- You or someone you know is arrested.
- You will need to hire an attorney to handle the case. I will review the issues with you over the phone to determine if your case is one where a writ bond can be filed.
- I will meet you (usually at the jail) to get you to sign some paperwork. I will fill out paperwork and get the bond paperwork signed by the jailed individual as well.
- Our Attorney files the Writ of Habeas Corpus, along with the bond paperwork, and other paperwork at the Collin County Jail. This will force the jail to set a bond.
- I will then write the bond for the jailed individual and this will allow them to be released.
- The Collin County Jail will then send a fax to the local jail (Frisco or Plano) and release the jailed person. You can remain there to give them a safe ride home. If this is a DWI case, your loved one must appear with attorney at a preliminary hearing on Monday next after being released from jail to see if an interlock device will be ordered or not.
- I will provide you with plenty of materials so that you and your loved one know “What happens from here”, including upcoming hearings, our representation of them, etc.
